This Legal Disclaimer (“Disclaimer”) governs all business listings (“Listings”) published on the VW Owners Club website and associated platforms (collectively, the “Platform”). By submitting a Listing for publication on the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Disclaimer.
In this Disclaimer, unless the context otherwise requires:
1.1 “VW Owners Club” means the VW Owners Club, its owners, directors, employees, volunteers, contractors, and authorised representatives.
1.2 “Advertiser” means any individual, company, partnership, or other entity that submits a Listing for publication on the Platform.
1.3 “Listing” means any advertisement, announcement, or promotional content submitted by an Advertiser for publication on the Platform.
1.4 “Platform” means the VW Owners Club website, mobile applications, social media accounts, print publications, and any other channels owned or operated by VW Owners Club.
1.5 “Administrative Charges” means any costs incurred by VW Owners Club in processing a Listing or a refund request.
2.1 All Listings submitted to VW Owners Club must be approved before publication. VW Owners Club reserves the absolute right to refuse publication of any Listing at its sole discretion without providing reasons.
2.2 The publication date of an approved Listing (“Live Date”) shall be the date on which the Listing first appears on the Platform.
2.3 VW Owners Club makes no guarantees regarding the timing of the approval process or publication of Listings.
3.1 Following the Live Date, Advertisers shall have a grace period of fourteen (14) calendar days (“Cooling-off Period”) during which they may cancel their Listing and request a refund.
3.2 All cancellation requests must be submitted in writing to the contact details provided on the Platform.
3.3 After the expiry of the Cooling-off Period, the contract between VW Owners Club and the Advertiser shall be deemed final, and no refunds shall be issued for any reason whatsoever.
4.1 If a cancellation request is received within the Cooling-off Period, VW Owners Club shall process a refund of the fees paid by the Advertiser, subject to the deductions set forth in clause 4.2.
4.2 All refunds shall be subject to deduction of: (a) Administrative charges, which may include but are not limited to staff time, processing costs, and other reasonable expenses incurred by VW Owners Club; and (b) Bank transaction charges and any other payment processing fees applicable to the original payment and the refund.
4.3 The amount of Administrative charges shall be determined by VW Owners Club at its reasonable discretion and shall reflect the actual costs incurred.
4.4 Refunds shall be processed using the same payment method as the original payment unless otherwise agreed in writing.
5.1 VW Owners Club does not guarantee uninterrupted access to the Platform and reserves the right to suspend access for maintenance, updates, or any other reason without prior notice.
5.2 In the event that the Platform becomes inaccessible or unavailable for any reason (“Downtime”), VW Owners Club shall, at its sole discretion, extend the duration of all active Listings by a period equivalent to the Downtime.
5.3 The extension described in clause 5.2 shall be the Advertiser’s sole and exclusive remedy for any Downtime, and VW Owners Club shall have no further liability in this regard.
5.4 VW Owners Club shall be the sole arbiter of the duration of any Downtime and the corresponding extension to be applied to Listings.
VW Owners Club works diligently to ensure that the Platform is well-managed, secure, and current. However, VW Owners Club makes no warranties, representations, or guarantees (whether express or implied) regarding the effectiveness of any Listing, the number of views or interactions a Listing may receive, or the commercial benefits that may arise from a Listing.
To the fullest extent permitted by law, VW Owners Club expressly disclaims and shall have no liability whatsoever (whether in contract, tort, negligence, misrepresentation, strict liability, or otherwise) for:
Without prejudice to the generality of clause 6.2, VW Owners Club specifically disclaims any liability for any loss of earnings, revenue, or business opportunities through advertising or any other means in connection with the Platform.
The limitations and exclusions of liability set forth in this Disclaimer shall apply even if VW Owners Club has been advised of the possibility of such damages.
Nothing in this Disclaimer shall limit or exclude VW Owners Club’s liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law.
7.1 By submitting a Listing, the Advertiser represents and warrants that:
7.2 The Advertiser shall indemnify, defend, and hold harmless VW Owners Club from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with any breach of the representations and warranties set forth in clause 7.1.
8.1 VW Owners Club reserves the right to edit, modify, or remove any Listing at any time and for any reason without notice.
8.2 Reasons for modification or removal may include, but are not limited to:

9.1 By submitting a Listing, the Advertiser grants to VW Owners Club a non-exclusive, royalty-free, worldwide licence to reproduce, publish, display, distribute, and otherwise use the Listing on the Platform and in promotional materials related to the Platform.
9.2 The Advertiser acknowledges that all intellectual property rights in the Platform (excluding the content of Listings) are owned by or licensed to VW Owners Club.
10.1 This Disclaimer constitutes the entire agreement between VW Owners Club and the Advertiser with respect to its subject matter and supersedes all prior agreements, understandings, and communications, whether written or oral.
10.2 If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
10.3 No failure or delay by VW Owners Club in exercising any right under this Disclaimer shall operate as a waiver of that right, nor shall any single or partial exercise of any right preclude any further exercise of that or any other right.
10.4 VW Owners Club reserves the right to modify this Disclaimer at any time by posting an updated version on the Platform. Continued use of the Platform after such modifications shall constitute acceptance of the modified Disclaimer.
10.5 This Disclaimer shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts for the resolution of any disputes arising under or in connection with this Disclaimer.
10.6 Any notice required to be given under this Disclaimer shall be in writing and shall be delivered by hand, sent by pre-paid first-class post or other next working day delivery service, or sent by email to the contact details provided on the Platform.
10.7 A person who is not a party to this Disclaimer shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
